DLA PIPER solicitors for LOWELL’S FINANCIAL LIMITED, continue their demand that SAFE removes from its website the 31st August 2007 Annual Return of their client’s subsidiary, Lowell’s Portfolio I Ltd., which as the law prescribes shows the names and addresses of the Officers of Lowell’s. In November 2007 the officers of the Lowell Group applied to the DTI for exemption from having to display their addresses via Companies House as they feared retaliation from unhappy clients, (A Google of ‘Lowell’s or Red Debt Collections shows there seems to be a lot). The ability for an ‘exemption’ was brought in by government in 2002 by way of Statutory Instrument, SI 2002 No. 912 because of the demonstrations against staff employed as animal researchers etc. Who would have thought that Financial Services Industry officers would feel similarly threatened? Companies House say they are obligated to keep available all records which pre date the exemption Order as they are in the Public Domain and are Public Record and available to the public for the due fee, (£1). The Information Commissioners Office was sympathetic to Safe’s problem, but none the less was confused as they had never come across this before and agreed to look into the matter. SAFE as Secretariat to the APPG (All Party Parliamentary Group) Against Financial Exploitation is considering raising the matter in the Commons by written questions. Therefore, until the confusion is resolved, SAFE has temporally taken down the 2007 Annual Return which contained the names and addresses, of Lowell’s officers. This means anyone who requires them will have to pay the nominal search fee to Companies House to access their records as we did. Related Articles: |
