1. This is my third report as the Adjudicator appointed under the Shared Appreciation Mortgage (SAM) Hardship Scheme set up by Barclays Bank plc (the Bank) in mid-2007. It is in fact my second annual report, but, since I delivered a mid-year report in the summer of 2008, it concentrates on the second six months of the year. |

Shared appreciation mortgages, briefly available in the mid-1990s, are hitting the headlines again.
Capable of raising finance for the cash-poor and asset- rich, particularly those in or near retirement, Sams have been criticised for being expensive and inflexible. A recent change in the law raises the possibility that borrowers can go to court to get out of these contracts and recover their losses.

A Warwickshire man has told Mercia he feels trapped in his own home because if he ever moves, he will have to pay his bank a fortune. He is taking legal action against the Halifax Bank of Scotland after he was sold a Shared Appreciation Mortgage ten years ago. INTERVIEW: CUSTOMER - I would have to pay back a total of about ?300,000. Presenter - Halifax Bank of Scotland have refused to comment. |
